THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2448 OF 2015 ORDER :

This writ petition is filed seeking writ of mandamus directing the respondents to lay CC road in the existing katcha roads at Bharat Nagar Colony covered by Sy.No.152/7 and 161/1 of Chinagantyada village, Gajuwaka, Visakhapatnam in pursuance of the letter addressed by the 2nd respondent dated 07.07.2012.

Counter affidavit is filed by the respondents 2 and 3 stating that they have made inspections in Sy.Nos.152/7 and 161/1 of Chinagantyada village, Gajuwaka, Visakhapatnam in pursuant to representation dated 10.12.2013 made by the petitioner-Sangam and it is found to be government land and that it is not possible to lay road as there is no existing road in the survey number. Heard learned counsel for the petitioner as well as Sri S.Laxminarayana Reddy, learned Standing Counsel for respondents 2 and 3.

In view of the averments made in the counter affidavit filed by the respondents 2 and 3 stating that there is no existing road in the survey numbers as mentioned above and the said land being a government land, there is no possibility to lay road, I do not see any merit in the writ petition and same is misconceived and is liable to be dismissed. Accordingly, this writ petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
