HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD W.P.M.P.No.9973 of 2008 I N/ AND W.P.No.2683 of 2008 ORDER:

This writ petition is filed questioning the order of the 3rd respondent in proceedings RC No.5/2008, dated 08.01.2008 and to direct the respondents to continue the writ petitioner as Anganwadi worker at Pusala Colony Anganwadi centre, Ayyawaripalli, Sitarampuram Mandal, Nellore District for the entire contractual period in terms of the appointment order dated 26.12.2007.

Learned counsel for the writ petitioner not present and there is no representation on her behalf.

W.P.M.P.No.9973 of 2008 is filed by one Chevuri Sobha Rani, proposed respondent seeking her impleadment as respondent No.4 in the writ petition. Learned counsel appearing for proposed respondent No.4 submits that respondent No.4 has some interest in this writ petition as she has also applied for the post of Anganwadi worker on 14.09.2007 and therefore, sought for her impleadment in this writ petition.

As a matter of fact, this writ petition is filed by one Smt.Shaik Hasina stating that she belongs to Muslim Minority Community, and the 3rd respondent vide proceedings dated 26.12.2007 appointed her as Anganwadi worker for a period of one year, and that she was selected by the District Anganwadi Selection Committee to the Anganwadi Center at Pusala Colony, Ayyawaripalli, Sitarampuram Mandal and that she joined duty at the center on 27.12.2007 and has been running the center since then. The 3rd respondent by the impugned order dated 08.01.2008 removed the writ petitioner as Anganwadi worker of the center and the impugned order was served on her on 10.01.2008. The writ petitioner also filed W.P.M.P.No.3453 of 2008 and this Court granted interim direction on 12.02.2008 to the respondents to continue the writ petitioner as

Anganwadi worker of Ayyawaripalli, Sitarampuram Mandal, Nellore District, if she is continuing as such as of then, until further orders. The writ petitioner is not present before the Court to represent about the facts of the case as to whether she is continuing as Anganwadi worker of Ayyawaripalli, Sitarampuram Mandal, Nellore District or not and therefore, she cannot seek any further directions in this matter. Since the writ petitioner has failed to appear before this Court, it appears that she is not inclined to prosecute this writ petition. The directions issued in W.P.M.P.No.3453 of 2008 were of the year 2008, and since then there is no information placed before this Court whether the writ petitioner was continuing as Anganwadi worker or not.

In view of the facts and circumstances of the case since the writ petitioner has failed to appear before this Court, this Writ Petition is dismissed. As far as W.P.M.P.No.9973 of 2008 is concerned, it is also liable to be dismissed as the very writ petition filed by the writ petitioner is dismissed. Respondent No.4 may approach the concerned authorities for remedies available to her under law. No order as to costs.
