There is no representation on behalf of the petitioner. 2.

The prayer sought in the writ petition is as under: 'For the reasons stated in the accompanying affidavit the petitioner herein prays that this Hon'ble court may be pleased to issue a writ, order or direction more particularly one in nature of writ of Mandamus, declaring the action of Respondents 2 to 3 in not filing final report for taking cognizance of offence in Crime No.35 of 2013 dt.14-09-2013 on the file of Siddapur P.S., Mahaboobnagar District as illegal and arbitrary and consequently direct the Respondents 2 to 3 to file final report for taking cognizance of offence in Crime No.35 of 2013 dt.14-09-2013 on the file of Siddapur P.S., Mahaboobnagar District and to pass such other orders as this Hon'ble Court may deem fit and proper in the circumstances of case, in the interest of justice.' 3.

Learned Government Pleader appearing for respondents 1 to 3 placed on record the written instructions issued by the Sub-Inspector of Police, Siddapur Police Station, Mahabubnagar District. 4.

From the perusal of the said written instructions, it is revealed that pursuant to the complaint lodged by the petitioner the third respondent registered a case in Crime No.35 of 2013 for the offences under Sections 447, 324, 323, 504, 506 read with Section 34 IPC. During the course of investigation, it is elicited that respondents 4 to 7 have committed an offence and thus, they were arrested and sent to judicial custody on 23.09.2013. After completion of investigation, the third respondent filed a charge sheet before the Judicial Magistrate of First Class, Achampet, on 29.09.2013. The lower Court after taking cognizance of the offences,

numbered the case as C.C.No.1 of 2014. Learned Government Pleader also brought to the notice of this Court that the said Calendar Case is still pending consideration.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition, since the charge sheet has already been filed and the same is liable to be dismissed. 6.
