This Writ Petition is filed seeking writ of mandamus declaring the action of the 2nd respondent in not deciding the appeal dated 25.11.2015 filed assailing the order of the 4th respondent in proceedings Rc.No.162/2015/GNV/E2, dated 29.08.2015.

Sri M.S.R.Chandra Murthy, learned Standing Counsel for the respondents 3 and 4 submits that there is no appeal pending before the 2nd respondent and that the 3rd respondent is the appellate authority.

Learned counsel for the petitioner submits that liberty may be granted to file appeal before the 3rd respondent-District Collector.

In view of same, it is open for the petitioner to prefer appeal before the appellate authority and the appellate authority is directed to dispose of the same in accordance with law. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
