Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 3.
This Writ Petition is filed seeking to declare the action of the 2nd respondent in not considering the application of the petitioner for appointment as fair price shop dealer of Vanikunta Village, Ipur Mandal, Guntur District, as arbitrary and illegal.
The father of the petitioner was appointed as fair price shop dealer of Vanikunta Village, Ipur Mandal, Guntur District, on permanent basis and died on 22.04.2014. After the death of his father, the petitioner submitted an application to the 2nd respondent on 24.11.2014 seeking to appoint him as fair price shop dealer, on compassionate grounds. But, the 2nd respondent has not passed any orders thereon. Learned counsel appearing for the petitioner submits that as per G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28.02.2014, the petitioner is eligible for appointment as fair price shop dealer on compassionate grounds. Considering the aforesaid submission, the writ
petition is disposed of directing the 2nd respondent to consider the application made by the petitioner on 24.11.2014 seeking appointment on compassionate grounds in terms of G.O.Ms.No.4, dated 28.02.2014, within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
