ON'BLE SRI JUSTICE S.V. BHATT W.P. No.38852 OF 2015 ORDER:

The petitioner challenges show cause notice No.G6/ 1196/ 2007 dated 23.11.2015 on various legal and factual grounds.

This Court on 30.11.2015 granted interim suspension of the show cause notice. The contesting respondent filed a petition to vacate the interim order and along with the counter affidavit, enclosed a few annexures in support of the case of 3rd respondent. The counsel for petitioner submits that, for the present, the petitioner is content if reasonable time is granted for submitting explanation to the show cause notice and the status quo as on date may be directed to be continued for some time. On the limited submission of petitioner, the counsel for respondents are also heard and keeping in view the scope of enquiry before 2nd respondent, I am satisfied that the writ petition can be disposed of by this order:

a) the petitioner is given two weeks time from today to submit explanation to the show cause notice impugned in the writ petition.

b) the 2nd respondent is directed to dispose of the issue on which enquiry is initiated through the notice impugned in the writ petition within four weeks from the date of receipt of explanation

c ) the parties are directed to maintain status quo as on date for a period of six weeks from today.

d) the consideration or granting status quo as on date for a limited period, it is made clear shall not be understood as this Court expressing any view on the case of either petitioner or 3rd respondent.

The writ petition is disposed of accordingly. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT, J Date: 13.09.2017 Stp
