extension of time for a period of six (06) months for disposal of D.V.C.No.7 of 2018, which is pending on the file of the learned II Additional Junior Civil Judge-cum-II Additional Judicial Magistrate of First Class Court, Medchal-Malkajgiri District, at Kushaiguda.
The petitioner herein filed Crl.P.No.6786 of 2021 seeking a direction to Court concerned for disposal D.V.C.No.7 of 2018 as expeditiously as possible. This Court, vide order dated 07.01.2022, disposed of the said Criminal Petition by directing concerned Magistrate to dispose of D.V.C.No.7 of 2018 within a period of 60 days from the date of receipt of copy of the order. Since the said direction was not compiled within the stipulated time, the learned Trial Judge has
addressed a letter seeking extension of time for a period of (6) months for the disposal of D.V.C.No.7 of 2018. The letter of the learned II Additional Junior Civil Judge-cumII Additional Judicial Magistrate of First Class, Medchal-Malkajgiri District at Kushaiguda dated 25.03.2026, which was forwarded by the learned Principal District & Sessions Judge, Medchal-Malkajgiri District vide letter dated 30.03.2026 addressed to the Registrar (Judicial) of this Court are also enclosed along with this I.A.
perusal letter dated 25.03.2026 discloses that the learned trial Judge addressed a letter to the Registry seeking extension of time for further period of six months for disposal of D.V.C. No.7 of 2018, though the matter was required to be disposed of within sixty days. However, in the meantime, the Supreme Court of India passed stay orders on 09.05.2022 and 15.06.2022, and therefore, the matter could not be proceeded with. It is also submitted by the officer that she assumed charge of the said Court on 26.10.2024 and has been putting her best efforts to dispose of the matter.
The said stay orders were subsequently vacated on 04.12.2024 in
Special Leave Petition (CRL) Nos.33643365 of 2022, and in pursuance thereof, steps have been taken to expedite the matter. However, both the parties have been filing one petition or another, resulting in prolonged proceedings. It is further submitted by the officer that she was ailing with ill health and was on commuted medical leave, which has also contributed to the delay in disposal. At present, the matter stands posted for further cross-examination of PW-3. The officer has stated that the Court shall make an endeavour to dispose of the matter at the earliest and has sought further time of six months for disposal of the said D.V.C.
However, considering circumstances stated above by the learned Trial Judge vide her letter cited supra, this Court hereby extends the time for a period of three (3) months from the date of receipt of a copy of this order for disposal of D.V.C.No.7 of 2018, which is pending on the file of the learned II Additional Junior Civil Judge-cum-II Additional Judicial Magistrate of First Class Court, Medchal-Malkajgiri District, at Kushaiguda.
I.A.No.1 is ordered accordingly.
Registry is directed to communicate this order to concerned Court immediately.
