HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 28173 of 2016 Order:

The petitioner is working as Accounts Officer in Prisons Department. He was posted as Assistant Accounts Officer in the office of the first respondent in the year 2010 and even after promotion as Accounts Officer he was allowed to continue in the said office. He levelled several allegations against the respondents 5 to 7 and filed the present Writ Petition seeking a Writ of Mandamus declaring the action of the respondents 1 to 4 in not taking action against the respondents 5 to 7.

2. When this Court pointed out how the present Writ Petition is maintainable against the respondents 5 to 7 in respect of the allegations levelled against them as it is an administrative matter which can be brought to the notice of the concerned authorities, learned counsel for the petitioner sought time and produced before this Court a representation made to the first respondent on 25.08.2016.

3. Learned Government Pleader submits that the petitioner cannot include the respondents 2 to 4 who are not concerned with the allegations and including the two States in the present Writ Petition is bad.

4. This Court is not inclined to entertain the present Writ Petition, but in view of the representation submitted by the petitioner on 25.08.2016 to the first respondent, it is for the first respondent to take appropriate action as he deems fit on the representation submitted. This Court cannot issue a Writ of Mandamus as sought for on the basis of the allegations levelled against the respondents 5 to 7. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
