HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12523 OF 2017 ORDER:

The case of the petitioner is that he is an Ex-Serviceman and retired in the year 1980. In the year 1982 he was assigned agricultural land of Ac.5.00 in Survey No.314 Part subsequent Survey No.385/1 of Kapuluppada Village, vide DR No.310/91 under Ex-serviceman category. He brought the said land under cultivation and has been in peaceful possession and enjoyment of the said land. Subsequently, he came to know that the land assigned to Ex-servicemen can be sold at their will after completion of 10 yers from the date of their assignment, as such, he placed the said land for sale and entered into an agreement of sale-cum-general power of attorney with one B.V.Satyanarayana.

Thereafter, he approached the Sub-Registrar's office, Beemunipatnam for registration of the said document. Then it was brought to his notice that his name and requisite entries were not entered in the Web Land Adangal by the respondent authorities in respect of the said land. As such, he approached the 4th respondent for effecting entries in his favour in the Web Land Adangal pertaining the said land. As no action is being taken, the petitioner made a representation to the 3rd respondent to make entries in the Web Land Adangal and to issue epattadar pass book and title deed in his favour. As no action

is being taken by the respondents, inspite of submitting representation, present writ petition is filed. Heard both sides.

In view of the aforesaid facts and circumstances, the 3rd respondent is directed to consider the application of the petitioner dated 04.01.2017, in accordance with law, by taking the above facts into consideration, after issuing notice and affording opportunity of hearing to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs.
