HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 22943 of 2002 O R D E R:- This writ petition is filed seeking to issue a writ of Mandamus declaring action of the respondent in not releasing the petitioner's retirement and terminal benefits including ex-gratia, gratuity, arrears of salary, etc. as illegal and arbitrary and consequently direct the respondent to pay retirement and terminal benefits including ex-gratia, gratuity, arrears of salary, etc.

When this matter is taken up for hearing, Sri J.Sreenivasa Rao, learned Standing Counsel for Singareni Collieries Company Limited appearing on behalf of the respondent has submitted that an amount of Rs.3,06,458/ - was already deposited and credited to the petitioner's account as is reflected in paragraph No.6 of the writ affidavit. That apart, he has further submitted that the petitioner is entitled to gratuity, leave encashment and other benefits and the same will be paid to him if not already paid. In view of the above submission, the writ petition is disposed of directing the respondent to pay gratuity, leave encashment and other benefits to the petitioner as per his entitlement, within a period of four weeks from the date of

AKS,J WP_22943_2002 receipt of a copy of this order if not already paid. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
