THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.4713 of 2019 ORDER:

This Criminal Petition under Section 482 of Cr.P.C., is filed by the petitioner/accused seeking to quash the proceedings in C.C. No.360 of 2005 on the file of XII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, registered for the offences under Sections 419 and 420 IPC and under Section 30 of Arms Act, 1959 read with Rule 51-A of Arms Rules, 1962, against him. 2.

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

Though the petitioner has raised several grounds to quash the proceedings in the aforesaid case, learned counsel for the petitioner requested this Court to dispense with the appearance of the petitioner/accused in the aforesaid case before the trial Court. 4.

Learned Additional Public Prosecutor submits that since the identity of petitioner is not in dispute, his presence in the above case may not be necessary on every date of adjournment. 5.

In view of the aforesaid submissions, the appearance of the petitioner/accused in C.C.No.360 of 2005 on the file of XII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, is dispensed with, except on the dates whenever his presence is required by the trial Court and he shall be represented by his counsel. Further, as the C.C. is of the year 2005, the trial Court is directed to commence trial in the said C.C., and dispose of the same in accordance with

GSD, J CRL.P.No.4713 of 2019 law as expeditiously as possible, preferably, within a period of six months from the date of receipt of a copy of this order. 6.

With the above direction, the Criminal Petition is disposed of. 7.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
