THE HON'BLE SRI JUSTICE R. KANTHA RAO WRIT PETITION No.8162 of 2015 ORDER:

This writ petition is filed seeking a Writ of Mandamus declaring the action of the respondents in not allotting the essential commodities quota to the petitioner's Fair Price Shop No.26, Phirangipuram Village and Mandal, Guntur District, during the subsisting of the authorization and without there being any disciplinary proceedings as illegal and arbitrary.

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies [A.P.]. The Panchanama shows that there are no variations in the stocks, which are available as per the sales register. It seems that the stocks were seized on suspicion that the said stocks were stored for the purpose of selling them in black market. This Court does not find any justification for seizure of the stocks. Therefore, the writ petition is disposed of directing the respondents to release the essential commodities to the petitioner during the subsistence of the authorization of the petitioner.
