THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.6335 OF 2017 ORDER:

The petitioner complains against the inaction of respondents 2 to 4 in conducting survey vide Survey No.303/3 vide application dated 15.10.2016, an extent of Acres 2.10 cents of Marlapaka Village, Yerpedu Mandal, Chittoor District, as illegal and refusing to exercise the jurisdiction conferred on respondents 2 to 4. 2.

At request of respondents on 23.02.2017, the writ petition was adjourned by two weeks. The Assistant Government Pleader for Revenue requests further time to get instructions. The request to get instructions is refused, since the prayer is one against the inaction and this Court is satisfied, the writ petition can be disposed of by this order: Respondents 2 to 4 are directed to examine into the request of petitioner made through application dated 15.10.2016, within twelve (12) weeks from the date of receipt of a copy of this order and conduct survey of survey No.303/3, Acres 2.10 cents of Marlapaka Village, Yerpedu Mandal, Chittoor District, by following the procedure stipulated by Survey and Boundaries Act. It is needless to observe that the neighbouring owners are heard while conducting survey and demarcation of the extent covered by the application.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
