ORDER:
This writ petition is filed for the following relief: "....to issue any writ, order or direction, particularly one in the nature of Mandamus declaring the notices issued under Ref.No. RCB: 61/2004 dated 07.09.2011 and 15.09.2011 of the 2nd respondent and nullify the same as arbitrary, illegal, contrary to law..."
When the matter was listed for admission on 18.10.2011 none appeared for the petitioners. Hence the matter was adjourned to next week. Unfortunately, the matter was not listed thereafter. Again it was listed on 03.06.2015 and on that day also none appeared for the petitioners and there was no representation on their behalf. Hence the matter was directed to be listed today under the caption "For Dismissal".
Today, when the case is called, Sri P. Venkatarama Sarma, learned counsel appearing on behalf of Dr. P.B. Vijaya Kumar, learned counsel for the petitioners, submits that a civil suit bearing O.S.No.118 of 2009 was pending on the file of the District Judge, Nellore and subsequently, the same was transferred to VII Additional District Judge, Gudur and renumbered as O.S.No.213 of 2014. In view of the same, the learned counsel for the petitioners does not wish to press the writ petition as the parties would be governed by the decision that may be rendered in the civil proceedings.
Accordingly the writ petition is closed. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
