THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.14295 OF 2018 ORDER:
In this Writ Petition, under Article 226 of the Constitution of India, the grievance of the writ petitioner is against the action of the 2nd respondent in interfering with the construction activity of the petitioner over the land admeasuring Ac.0-08 guntas in Sy.No.328/1/2/1 situated at Ponkal Shivar, R/M.Jannaram, Mancherial District, without any reason.

I have heard the submissions of Sri Pramod Singh, learned counsel for the petitioner, of the learned Government Pleader for Home (TG), appearing for the respondents 1 and 2, and of the learned Government Pleader for Revenue (TG), appearing for the 3rd respondent. I have perused the material record. 3.
At the hearing, learned counsel for the petitioner submits that the petitioner is the owner of the above said land and that he is in peaceful possession of the same; that the said land was allotted to him being a poor person belonging to reserved class; and, that when he is proceeding with making of constructions by obtaining a building permission, the police officers, without any manner of right or reason, are interfering with the said activity at the instance of some political persons and are pressurizing him to sell away the property.

Though no specific allegations are made against the 3rd respondent in the writ petition, learned counsel for the petitioner would submit that after the filing of the writ petition, the 3rd
respondent is also causing interference to the construction activity of the petitioner.

Learned Government Pleader for Home, on written instructions, dated 23.04.2018, a copy of which is placed on record, submits that all the allegations in the writ petition are false; that the 2nd respondent never interfered with the alleged construction activity over the subject property; and, that the allegations in the writ petition are invented for the purpose of the present writ petition.

Having regard to the submissions, the Writ Petition is disposed of directing the Station House Officer, Jannaram Police Station, Mancherial District/2nd respondent herein, and the 3rd respondent not to interfere with the construction activity being undertaken by the petitioner as per building permit, over the subject property. There shall be no order as to costs. Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
