Utukari Ilaiah v. Bathini Mogili

2018-09-04S.V.Bhatt2 pages

THE HON'BLE SRI JUSTICE S.V.BHATT C.R.P.No.2840 of 2018 ORDER:

Heard Mr.K.Venumadhav for revision petitioner and Mr.T.Dayananda Rao for 1st respondent.

The revision petitioner filed I.A.No.491 of 2017 to set aside the ex-parte order dated 07.03.2007.

The trial Court through the order impugned in the Civil Revision Petition rejected the prayer. One of the reasons recorded by the trial Court is that the affidavit filed in support of the prayer for setting aside the order dated 07.03.2007 is bereft of reasons. This Court can accept the contentions raised by Venumadhav, firstly, if it is substantially shown to this Court that the affidavit contains details and secondly these details constitute sufficient reasons for not moving the Court at the earliest point of time. As there is no exception to the finding recorded by the trial Court, I do not see any reason to interfere with the order under revision.

Hence, the Civil Revision Petition fails and accordingly dismissed. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed. ________________ S. V. BHATT, J Dt: 04.09.2018 dv
