HON'BLE SRI JUSTICE R. KANTHA RAO Contempt Case No.1482 of 2015 ORDER:

Heard Smt. M. Suguna, learned counsel appearing for the petitioner and Sri P. Durga Prasad, learned standing counsel for APSRTC.

2. The petitioner filed writ petition stating that due to illness suffered by him, he is not able to discharge the duties of the Conductor and a direction has to be issued to the respondent-Corporation to assign him duties, other than those the Conductor, which he is able to perform. It is also mentioned in the writ petition that he made a representation to the Corporation with the same request.

3. This court passed an interim order directing the Corporation to consider his representation and pass appropriate orders. Thereafter, the Corporation assigned him other duties and subjected him to medial examination. Learned standing counsel for the Corporation produced copy of the medical examination report of the petitioner, which shows that the petitioner is fit to discharge the duties of the Conductor. Basing on the medical fitness certificate, Corporation directed the petitioner to perform the duties of the Conductor, for which the petitioner submitted an explanation before the Corporation stating that the Corporation unnecessarily subjected him to medical examination and forcing him to discharge the duties of the Conductor.

4. The contention put-forth by the petitioner and his explanation to the direction issued by the Corporation, cannot be adjudicated in the present contempt case. If the petitioner wants to challenge the fitness certificate, he can do so in a separate writ or other proceeding. Hence, the contempt case is closed. No order as to costs. Miscellaneous petitions, pending if any in this case, shall stand closed.
