THE HONOURABLE SRI JUSTICE S.V.BHATT WRIT PETITION No.16264 OF 2016 O R D E R :

Writ petitioner assails notice 06.05.2016 issued by the 3rd respondent under A.P. Land Encroachment Act, 1905 proposing to evict her from the subject land. Petitioner apprehends that before she could submit explanation to the said notice, the 3rd respondent might evict her from the subject land.

Learned Government Pleader for Revenue appearing for the respondents states that if the petitioner submits explanation to the impugned notice within a period of four (04) weeks from the date of receipt of a copy of this order, the 3rd respondent will then pass a reasoned order in accordance with law, within a period of six (06) weeks therefrom, after considering the explanation submitted by her. He assures that the petitioner will not be dispossessed from the subject land till a final order is passed by the 3rd respondent. In this view of the matter, the Writ Petition is disposed of granting liberty to petitioner to submit explanation to the notice dt.06.05.2016 within a period of four (04) weeks from the date of receipt of a copy of this order.

If no explanation is furnished to the 3rd respondent within the said time, it is open to the 3rd respondent to decide the matter exparte. If explanation is submitted by petitioner within the time aforementioned, the 3rd respondent shall pass reasoned orders thereon within a period of six (06) weeks from the date of submission of explanation by the petitioner. Till final order is passed by the 3rd respondent and communicated, petitioner shall not be dispossessed from the subject land.

As a sequel, the miscellaneous applications pending, if any,
