THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 15123 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner is owner of Bolero Van bearing registration No.AP 31D 7139 on 24.02.2015. After delivery of vegetables in the market, he was waiting for engagement of the vehicle for transportation. At the request of one person, who wanted to deliver some bags to Gajuwaka market on hire charges, he took them on hire charges. The Gajuwaka police stopped the vehicle at 10.00 a.m. and handed over the same to the 3rd respondent in the presence of mediators on the allegation that the bags relate to PDS rice belonging to the fair price shops. The petitioner feels ignorance about the nature of the goods. It appears that 6-A proceedings were initiated by the 3rd respondent. The petitioner approached the 2nd respondent and sought release of the vehicle by filing a petition in SR.No.16 of 2015 and when the same was not being disposed of, the present writ petition is filed.

3. Though time was granted to the learned Government Pleader on 02.06.2015 for getting instructions, no instructions have been received by him.

4. In the circumstances, this Court is not inclined to keep the writ petition pending but directs the 2nd respondent to dispose of the SR.No.16 of 2015 filed by the petitioner by considering the same in accordance with law and pass orders within a period of one week from the date of receipt of a copy of the order.

5. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________
