THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.14362 OF 2018 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents. 2.

Petitioners claim that an extent of Acs.5.00 in Survey No.147/1 was assigned to one G.Ananthaiah, father of the second petitioner. After his death, the family members succeeded to the subject property, by internal arrangement. They have partitioned the land assigned to G.Ananthaiah. However, since the respondent-authorities are trying to interfere with their possession and enjoyment, petitioners requested the respondents for conducting of survey. Alleging inaction in conducting survey, this Writ Petition is filed.

Copies of endorsement given by the office of the competent authority on request made for conducting survey were enclosed. It appears that request was made for conducting of survey generally but no request was made in F-Line proforma, as required. 4.

This Court is not expressing any opinion on the merits of the case, as the petitioners have not made any application in F-Line proforma. The respondent-authorities can not be faulted for accepting the request of the petitioners when proper application was not made. Therefore, the relief sought for cannot be granted.

Leaving it open to the petitioners to make an application through F-Line proforma, as required, requesting to conduct survey, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
