HONOURABLE SRI JUSTICE N.V.SHRAVAN KUMAR WRIT PETITION (TR) No. 5856 OF 2017 ORDER:
This writ petition (TR) is filed to declare the action of the respondents in not considering the case of the petitioner for selection and appointment to the post of Assistant Engineer (Civil) in Roads Buildings Department though the petitioner possessed qualifications required in the Notification No.9/2015, dated 29.08.2015 as illegal and further direct the respondents to consider the case of the petitioner for selection and appointment to the post of Assistant Engineer (Civil) in Roads Buildings Department with all consequential benefits.

Learned counsel for the petitioner submits that the petitioner has applied to the post of Assistant Engineer (Civil) vide Notification No.09/2015 dated 29.08.2015, issued by the respondent authorities. It is further submitted that the petitioner was qualified in the written examination and called for Certification Verification. However, the petitioner was not allowed for web option and when the petitioner enquired about the same from the respondent No.1, it is stated that the petitioner was rejected on the ground that the computer certificates submitted by the petitioner is not equivalent to the prescribed qualification as per notification dated 29.08.2015.

Learned counsel for the petitioner submits that the requisite qualification for the post of Assistant Engineer (Civil) as per notification dated 29.08.2015 is as follows, Post code Name of the Post Educational Qualifications Assistant Engineers (Civil) in Roads and Buildings Dept., Must possess a Diploma in Civil Engineering awarded by the State Board of Technical Education or its equivalent qualification.
(ii) Must possess the Department of Electronics Accreditation of Computer Courses (DOEACC) 'O'
level computer qualification administered by the DOE ACC society under the Ministry of information Technology Govt., of India OR a Diploma of Certificate in Computer Application awarded by the State Board of Technical Education or its equivalent qualification as recognized by the State Board of Technical Education.
Learned counsel for the petitioner has drawn attention of this Court to the computer qualification possessed by the petitioner and the petitioner has also filed the Diploma in Computer Application from SSSIT, Kukatpally. Learned counsel for the petitioner further submits that as per the certificates, the petitioner is eligible and pray this Court to direct the respondent authorities to consider the case of the petitioner for appointment to the post of Assistant Engineer (Civil) in Roads and Buildings Department.

Learned Standing Counsel for TSPSC submits that he has no instructions and fairly submits that appropriate orders may be passed in this writ peiton(TR), in accordance with law.

On perusal of record, it is found that on 16.02.2023, learned Standing Counsel for TSPSC appearing for respondents sought time to file counter-affidavit and till date no counter has been filed by the respondents.

Recording the submission made by the learned counsel on either side and in view of the above facts, this Court deems it fit to direct the respondent authorities to consider the case of the petitioner for appointment to the post of Assistant Engineer (Civil) in Roads Buildings Department, after verifying the certificates submitted by the petitioner and if the petitioner is otherwise eligible in terms of the Notification No.9/2015 dated 29.08.2015 and pass appropriate orders strictly in accordance with law, as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of copy of this order, and communicate the same to the petitioner.
