THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 1016 of 2015 ORDER: (Per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) After hearing the learned counsel for the parties, we dispose of the writ petition directing the 3rd respondent to dispose of the petitioner's applications for granting stay of recovery proceedings in between 23.02.2015 and 05.03.2015, and till such disposal, we are of the view that respondent Nos.1 and 2 should not proceed because it is not in the hands of the petitioner. We also restrain the petitioner from transferring, alienating and disposing of the fixed assets and properties owned by it or its members till the disposal of the stay applications. Pending miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
