HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.2142 of 2017 ORDER:
This writ petition is filed challenging the action of the 3rd respondent in calling the petitioner to the Police Station. Learned Government Pleader for Home, on the basis of written instructions, submits that petitioner is called as "Guruji" and is accused in Cr.No.146 of 2015 registered on 09.08.2015 on the file of the P.S., Mahabubabad, Warangal District, for the offences under Sections 508 and 506 read with Section 34 IPC.
In view of the registration of crime against the petitioner, it cannot be said that the respondents cannot investigate the crime. It is stated by the learned Government Pleader that L.Ws.2 to 4 were examined and their statements were recorded and during the course of further investigation, notices were served to accused Nos.2 to 6 on 14.08.2015; investigation established that the accused have committed the offence; as such charge sheet was filed against them before the Judicial Magistrate of First Class, Mahabubabad in C.C.No.24 of 2016 and the same is coming up for trial on 28.01.2017 and the petitioner herein, who is accused No.1, is absconding since the date of registration of the crime.
In view of the above facts, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall stand closed. No costs.
