The petitioner, who is accused No.4, filed the present criminal petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking release in the event of her arrest in connection with C.O.R No.98 of 2025 of Prohibition & Excise Dhoolpet Police Station, registered for the offence punishable under Section 8(c) r/w 20 (b) (ii) (B) of Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard M/s. Umesh Singh, learned counsel for the petitioner and Sri M.Rama Chandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submits that the allegation leveled against the petitioner herein is that she is the wife of accused No.1, who assisted him in making 10 grams of ganja packets. But no material has been found as against the petitioner and neither the petitioner is in possession of the ganja nor the petitioner is present at the time of scene of offence. 4.

Learned counsel for the petitioner further submits that the petitioner is innocent and law abiding citizen and she is nothing to do with the said offences and she did not commit any offence and falsely implicated by the investigating agency without preliminary enquiry.

Learned Assistant Public Prosecutor submits that the case is under investigation and if the petitioner is granted anticipatory bail, she may threaten the witnesses. Hence, prayed to dismiss the criminal petition.

Having regard to the nature of the allegations and the submissions made across the Bar by the counsel for the petitioner, and considering the fact that the petitioner is the wife of Accused No.1, and she is alleged to have assisted in preparation of 10-gram ganja sachets, and that her implication as Accused No.4 appears to

be primarily on the confession statements of the co-accused, this Court is inclined to grant anticipatory bail to the petitioner/accused No.4 subject to following conditions:

1) The petitioner/accused No.4 is directed to surrender before the Station House Officer, Prohibition & Excise Station, Dhoolpet within a period of fifteen days from today.

2) On such appearance, the petitioner/accused No.4 shall be released on bail on her executing a personal bond for Rs.10,000/- (Rupees Ten thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer.

3) The petitioner/accused No.4 shall co-operate with the investigating agency and shall appear before the concerned Station House Officer on every Wednesday and Saturday between 10.00 a.m. and 11.00 a.m., for a period of four weeks or till submission of the charge sheet, whichever is earlier.

4) The petitioner/accused No.4 shall not indulge in any similar type of activities, in future.

5) The petitioner/accused No.4 shall not tamper with the prosecution witnesses.

6) The petitioner/accused No.4 shall co-operate with the investigating agency and she shall not misuse the liberty granted to her.

7) The petitioner/accused No.4 shall not leave the country without prior permission of the Court concerned and surrender her passport before the Court concerned. 7.
