THE HON'BLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION NO.17268 of 2019 ORDER:

This writ petition is filed to call for the records of the respondent No.3-Station House Officer, Central Crime Station, Hyderabad City, whereby respondent No.4-ICICI Bank was called upon to freeze the petitioner's bank account bearing No.625405017114 without issuing any notice to the petitioner or the reasons for such freezing of account, as illegal and arbitrary.

Heard Sri D. Narendar Naik, learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

When the matter came up for consideration on 11.09.2019 before this Court, an order was passed noting that the complaint is filed in respect of a sum of Rs.11,800/- and directed that the said amount of Rs.11,800/- shall be kept as balance in the account of the petitioner. Today when the matter has come up for hearing, the learned Assistant Government Pleader for Home, on instructions, would submit that based on the complaint made by one G. Prabhakar on 23.08.2019, a case has been registered by Cyber Crime Police Station, CCS, DD, Hyderabad. Since a crime has been registered and is under investigation, the amount of Rs.11,800/-, which this Court directed to be maintained in the bank account of the

petitioner with the respondent No.4-ICICI bank, shall always be maintained with a clear noting that the same is under lien marked by referring to the Crime No.690 of 2019. The lien marked shall be continued by respondent No.4 till further communication is received from respondent No.3 in this regard. Once respondent No.4 marks the lien over an amount of Rs.11,800/- to the said crime, the respondent No.4 shall defreeze the account and permit the petitioner to operate the same in normal course.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in this writ petition shall stand closed. ____________________ T.VINOD KUMAR, J Date: 30.10.2019 Isn
