THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.4096 of 2015 Between:
T.C.S. Shairpally, Alampur Mandal, Mahaboobnagar District, rep. by its President Krishnaiah Goud PETITIONER AND
1. State of Telangana, rep. by its Principal Secretary to government, Revenue (Excise) Department at Secretariat, Hyderabad, and others. RESPONDENTS
ORDER:
The petitioner holds a licence issued by the 3rd respondent herein for sale of toddy in the house located in Sy.No.146 of Shairpally Village, Alampur Mandal, Kurnool District. On the ground that the explanation submitted by the petitioner to the show cause notice dated 13.11.2014 was not satisfactory, the 3rd respondent issued impugned proceedings dated 23.01.2015 cancelling the licence of the petitioner. Aggrieved by the said order the petitioner preferred an appeal dated 12.02.2015, which is stated to be pending before the 2nd respondent. The grievance of the petitioner in this writ petition is that at least the interlocutory application filed along with the said appeal be heard and disposed of expeditiously.
Learned Government Pleader for respondents states that the 2nd respondent shall fix an early date for hearing and pass appropriate orders at least in the interlocutory application filed by the petitioner. In view of the said submission, the writ petition is disposed of directing the 2nd respondent to fix a date for hearing of the appeal or the interlocutory application and pass appropriate orders at least in the interlocutory application, within a period of three weeks from the date of receipt of a copy of this order. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
