THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9198 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.1 seeking to relax the conditions imposed by the XIII Additional Chief Metropolitan Magistrate (Mahila Court), Hyderabad vide order dated 30.3.2016 in Crl.M.P.No.1659 of 2016 in Crime No.699 of 2015. Heard and perused the material available on record. The petitioner filed the impugned application for release of his passport. The learned Magistrate while releasing the passport imposed conditions. One of the conditions is that the petitioner shall execute a self bond and deposit Rs.3 lakhs with one surety for the like sum. Aggrieved by the said condition, the petitioner filed this petition. The learned Additional Public Prosecutor opposed this petition. Considering the facts and circumstances of the case and the submissions made by the learned Counsel for the petitioner, the above condition is modified as follows:

"The petitioner shall execute a self bond and deposit Rs.2,00,000/- (Rupees Two Lakhs only) with one surety for the like sum to the satisfaction of the XIII Additional Chief Metropolitan Magistrate, Hyderabad."
