This Criminal Petition is filed seeking the Court to enlarge the petitioner on bail, who are arrayed as accused No.10 in Crime No.148 of 2026 of Allapur Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 318(4), 308(2), 144(2) and 62 read with 3(5) of BNS.

The brief facts of the case are that on 28.03.2026, complainant, who is the Sub-Inspector of Police lodged a report stating that on 27.03.2026, while performing night duty, on credible information, he along with staff proceeded to the Peeli Dargah area, Allapur, where they found two men and two women quarrelling. On enquiry, one person identified himself as Alipamula Shivarama Krishna and stated that at about 01:15 AM on 28.03.2026, he searched for "Hyderabad Escort Services" on Google and contacted a number provided on a website. He negotiated a meeting for Rs.8,000/-, and at about 02:00 AM, two women arrived at his room. One of them, who identified herself as Priya Roy, collected Rs.7,500/- through UPI and thereafter threatened to file a rape case and post the matter on social media, coercing him to transfer additional amounts totaling Rs.10,900/-.

When they attempted to leave without providing any services, he stopped them, whereupon both women, including another identified as Saheli Roy, threatened and abused him, falsely alleging rape and forcibly took his mobile phone before leaving in a cab. The victim chased them, retrieved his phone. Hence, requested the Police to take necessary legal action. Basing on the said complaint, a case was registered against them for the above said offences.

Heard Sri Rapolu Bhaskar, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for Respondent - State.

Learned counsel for the petitioner submitted that the petitioner, who is arrayed as Accused No.10, has been working as a cab driver and his duty is to pick book customer and drop them in the location and is innocent of the allegations made against him. He further submitted that the petitioner has been in judicial custody since 28.03.2026 and that the material part of the investigation has already been completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are serious and grievous in nature and the investigation is still in progress. Therefore, prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on

record, it appears that the petitioner is arrayed as accused No.10 and has been in judicial custody since 28.03.2026. As per the remand case diary, prosecution witnesses LWs.1 to 14, including the investigating authority, have already been examined. Considering the overall facts and circumstances of the case, the stage of investigation and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner‐accused, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned I Additional Junior Civil Judge-cum-XII Additional Metropolitan Magistrate, Medchal Malkajgiri District at Kukatpally.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
