HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 18483 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of certiorari calling for the records relating to the Award in I.D.No.58 of 2001 of the Labour court, Warangal, dated 31.01.2003, published on 12.06.2003 and to modify the same as being contrary to the provisions of law and consequently direct the respondents to reinstate the petitioner into the service with the continuity of service and all attendant benefits and back wages When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation and the petitioner is challenging the orders passed in I.D.No.58 of 2001, dated 31.01.2003 by the Labour Court, wherein no relief was granted to the petitioner. The petitioner was challenging the orders of removal before the Labour Court. The petitioner is seeking a relief to set aside the orders of removal and to reinstate the petitioner.

This court having considered the above said case, is of the considered view that the relief sought by the petitioner to reinstate him at this point of time may not be feasible in view of the retirement of the petitioner. However, this Writ Petition can be disposed of directing the petitioner to pay the service benefits for the service rendered by the petitioner for the period if not already paid, within a period of four weeks from the date of receipt of a copy of this order.

-2With these observations, the Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
