THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.35239 of 2015 ORDER:

Heard the learned counsel for petitioners and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioners claim to be agriculturists owning various extents of lands in Mangala Madaka Village, Mudigubba Mandal, Anantapur District. On 02.10.2015, when petitioners tried to sell the rice to various persons in vehicle bearing No.AP02V 7560, the fourth respondent seized the rice and submitted a report to respondents 2 and 3, based on which, 6-A proceedings were initiated against the petitioners. The petitioners submitted before the fourth respondent that there is no restriction on the transportation of rice as per the guidelines issued by the fifth respondent, and in spite of the same, the present proceedings were initiated against the petitioners an stock was seized. Challenging the same, the present Writ Petition is filed. 3.

In view of the pendency of proceedings before the second respondent, this Court is not inclined to interfere with the said proceedings. Learned counsel for the petitioners submits that the petitioners would take available pleas before the second respondent in the pending proceedings, but the stock seized shall not be sold pending the proceedings.

In the circumstances, the Writ Petition is disposed of directing the second respondent to dispose of the proceedings as early as possible, and since the stock is not perishable commodity, the seized stock shall not be sold pending disposal of the proceedings. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
