THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.14318 OF 2018 ORDER:
In this Writ Petition, under Article 226 of the Constitution of India, the grievance of the writ petitioner is in regard to the action of the 4th respondent, who is the Station House Officer, Keesara Police Station, i.e., 3rd respondent police station, in interfering with the civil disputes between the petitioner and the 5th respondent in respect of land in Sy.No.172 situated at Kundanpally Village, Keesara Mandal, Medchal Malkajgiri District.

I have heard the submissions of Sri Pottigari Sridhar Reddy, learned counsel for the petitioner, and of the learned Government Pleader for Home (TG), appearing for the respondents 1 to 3. I have perused the material record.

Learned counsel for the petitioner submits that since the police officer is interfering with the civil disputes between the petitioner and the 5th respondent, and is harassing the petitioner at the instance of the 5th respondent, the present writ petition is filed.

Learned Government Pleader for Home, on written instructions, dated 23.04.2018, a copy of which is placed on record, would submit that on the basis of the report lodged by the 5th respondent, a case in Crime No.150 of 2018 was registered, on 21.04.2018, against the petitioner herein and another for the offences punishable under Sections 447, 427 and 506 I.P.C.; that in the said report, it was alleged that an act of trespass has been
committed; that the police officer is only investigating into the said crime; that he never interfered with the alleged civil disputes; that the allegations in the writ petition are invented; and that the writ petition is filed to divert the attention of the Investigating Officer from conducting the investigation into the aforestated crime, on proper lines.

Recording the submissions, the Writ Petition is disposed of directing the Station House Officer, Keesara Police Station, Medchal District/3rd respondent herein, not to call the petitioner to the police station unless his presence is required during the course of investigation into the aforestated crime. There shall be no order as to costs.
Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
