THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.27980 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the procedure followed by the 2nd respondent in not issuing a notification calling up all the un-aided Minority Institutions to exercise their rights and form an association of minority institutions for the SW-II category for the B.Ed course and in selecting the 4th Respondent herein as the Association for conduct of admissions to Minority Educational Institutions under G.O.Ms.No.92 dated 16.11.2006 as illegal, arbitrary, unconstitutional and contrary to law declared by the Hon'ble Supreme Court of India apart from being violative of the petitioners' fundamental rights and to quash the said action and the entire admission process/procedure being conducted in violation of the rules made in G.O. Ms. No. 92 Education (SE-Trg-1) Department dated 16.11.
2006 and the law declared by the Hon'ble Supreme Court of India and to direct the Respondents to conduct admissions to B.Ed course only after following the procedures specified in the rules in G.O. Ms. No. 92 Education (SE-Trg-1) Department dated 16.11.2006 including by issuing a notification calling up all the un-aided/Minority Institutions to exercise its rights and form an association of minority institution as per the law laid down by the Hon'ble Supreme Court."
Heard Sri Tarun G Reddy, learned counsel for the petitioners and learned Government Pleader for Higher Education for respondents, apart from perusing the material available before this Court.
It is brought to the notice of this Court that for redressal of the grievance of the petitioners herein, the petitioners herein made a representation to the Secretary, Telangana State Council for Higher Education, Masab Tank Campus, Hyderabad - 2nd
respondent herein.
According to the learned counsel for the petitioners, no orders have been passed on the reprsentation said to have been submitted by the petitioners herein. As the said representation is still pending consideration before the 2nd respondent herein till date, this Court without going into the merits and demerits of the matter deems it appropriate to dispose of the writ petition by directing the 2nd respondent herein to take appropriate action on the said representation, dated 12-08-2015 by fixing some time frame.
For the aforesaid reasons, the writ petition is disposed of, directing the 2nd respondent - State Council to take appropriate action on the representation, dated 12-08-2015 said to have been submitted by the petitioners herein within a period of two (2) days from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
