HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.8823 OF 2015 O R D E R :

This writ petition is filed seeking Writ of Mandamus declaring the action of the 2nd respondent in insisting upon payment of the lease amount at Rs.9,900/- per month without considering the representation seeking to reduce the lease amount on par with the other adjacent shops and on par with other lessees in terms of the guidelines issued in G.O.Ms.No.56, dated 05.02.2011, as illegal and arbitrary and for a consequential direction to the 2nd respondent to consider and dispose of the representation dated 19.03.2015. The case of the petitioner is that in pursuance to the direction in W.A.Nos.1113, 1114, 1115, 1116, 1117, 1118, 1119 and 1120 of 2013, the petitioner was called for negotiations along with highest bidders and petitioner was accorded lease in respect of Shop No.7 on expressing his willingness to pay the highest bid amount of Rs.

9,900/-. The petitioner further states that as she was not able to pay the said lease amount, she made a representation to the 2nd respondent requesting him to reduce the lease amount on par with other shop owners. But the 2nd respondent though received the same did not pass any orders as on date. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner and Sri D.Bhaskar Reddy, learned Standing counsel for 2nd respondent.

Since the petitioner herself expressed her willingness to pay the highest bid amount of Rs.9,900/- at the time of negotiations, question of seeking reduction of the lease amount does not arise. Hence, the writ petition is misconceived and the same is accordingly dismissed. There shall be no order as to costs. As a sequel, miscellaneous petitions, pending, if any shall stand closed.
