THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44387 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to direct the respondents 1 and 2 to register case in pursuance of petitioner's complaint, dated 26.11.2016, against the respondents 4 to 7, and consequently, declare the inaction of the respondents 1 and 2 in registering case against the respondents 4 to 7, as illegal and bad. Heard and perused the material available on record. The main grievance of the petitioner is that the he made a complaint on 26.11.2016 to the Commissioner of Police, Visakhapatnam - 2nd respondent against the respondents 4 to 7 since they encroached his land and threatened him with dire consequences, but no action has been taken by the 2nd respondent on his complaint.

Considering the grievance of the petitioner, the respondents 2 and 3 are directed to register a case against the respondents 4 to 7, if the complaint lodged by the petitioner, dated 26.11.2016, discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved over the action of the respondents 1 and 2, he is at liberty to approach the superior officer of the 2nd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J December 20, 2016.
