HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.686 of 2014 ORDER:

This petition is filed to withdraw H.M.O.P.No.211 of 2012 from Family Court, Guntur and transfer the same to Family Court, Vijayawada for disposal in accordance with law.

2. Petitioner herein is husband and he filed his affidavit in support of the petition. According to his affidavit, he filed H.M.O.P No.211 of 2012 for dissolution of marriage and the O.P is filed at Guntur since marriage was performed within the jurisdiction of Guntur Court. He sated that father of respondent gave a complaint to Satyanarayanapuram Police, Vijayawada, on the basis of which, F.I.R is registered and after investigation charge sheet is filed, which is registered as C.C.No.694 of2013 and the same is pending before II Additional Chief Metropolitan Magistrate, Vijayawada. As no one is residing at Guntur, for convenience of both parties, the O.P filed by petitioner/husband may be transferred to Family Court, Vijayawada.

3. Other side has not filed any counter.

5. Considering the reasons stated in the affidavit, which remained unchallenged and also considering the convenience of both parties, H.M.O.P.No.211 of 2012 is withdrawn from the file of Family Court, Guntur and transferred to Family Court, Vijayawada for disposal in accordance with law.

6. Accordingly, the Transfer Miscellaneous Petition is allowed. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
