THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.1989 of 2017 ORDER:

This Contempt Case is filed alleging violation of the order, dated 09.08.2017, passed by this Court in WPMP.No.33098 of 2017 in Writ Petition No.26682 of 2017.

It is the case of the petitioner that the petitioner came to be issued with a notice, dated 06.09.2017 whereunder the respondent asserted that they have taken possession of plot No.149 and fenced the same and it is under the custody of Telangana Housing Board till final orders are passed by this Court.

The respondent filed a counter-affidavit, in paragraph 5 of which, it is averred that under the guise of the interim order of this Court, the petitioner has re-entered into plot No.149, stored Marble and Granite Slabs and carried out repairs partly therein and that the respondent had not taken any action against the petitioner and it is only to prevent the respondent from taking action against him, the petitioner filed the present Contempt Case.

CKR, J C.C.No.1989 of 2017 It is to be noted that there is no denial of the averments mentioned in the counter-affidavit, by the petitioner. In view of the facts and circumstances of the case, it can be said that this is not a case where there is any contempt on the part of the respondent.

Accordingly, this Contempt Case is closed.
