THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Criminal Petition No.4823 of 2018 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioner-accused, to quash the proceedings in Crime No.314 of 2018 of Gachibowli Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 509 & 506 of I.P.C. 2.

Heard the learned counsel for the petitioner-accused, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

The de-facto complainant is a divorcee of the petitioner-accused. They have a child. The de-facto complainant made some allegations against the petitioner-accused. The truth or otherwise of the allegations levelled against the petitioner-accused can only be determined after due investigation. In view of the nature of the offences alleged and in view of the relationship between the parties to the litigation, the interest of the petitioner-accused is required to be protected. 4.

Under these circumstances, the Station House Officer concerned is directed to complete the investigation and file Final Report before the Court concerned, without arresting the petitioner-accused. 5.
