THE HON'BLE SRI JUSTICE A.VENKATESHWARA REDDY CIVIL MISCELLANEOUS APPEAL NO.757 OF 2008 JUDGMENT:

Heard learned counsel for the appellants and the respondents. Learned counsel for the appellants would submits that OP.No.2217 of 2007 was allowed and the prohibitory injunction was granted restraining the respondent from joining the employment of 'Edeweiss Capital' Mumbai or any other third party, till the conclusion of Arbitration proceedings or passing of award by the Arbitrator.

2. It is further submitted that the agreement period is from 01.06.2006 and 31.05. 2019. Accordingly, no cause survives in this matter. At this stage, learned counsel for the respondent in Civil Miscellaneous Appeal would submit that in this CMA cause does not survive and requested to dispose of as infructuous.

3. While recording the above submissions, this Civil Miscellaneous Appeal is dismissed as infructuous. It is needless to mention that the order impugned is only confined to the period of agreements and it is already complied.

4. Miscellaneous applications, if any pending, shall stands closed.

5. In the circumstances of the case, there shall be no order as to the costs.
