THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.2275 of 2016 ORDER:
This Contempt Case is filed complaining inaction on the part of the respondents in implementing the order dated 14.06.2016, passed by this Court in W.P.M.P.No.22078 of in W.P.No.17964 of 2016.
It is pertinent to mention here that the petitioners in W.P.No.17964 of 2016 have also filed W.P.No.20280 of 2016 aggrieved by the inaction of the respondents 1 to 5 in taking action on their representation dated 20.06.2016 with respect to the interference of the respondent Nos. 6 to 10 with their property and the said Writ Petition has been disposed of as under: "A perusal of the complaint itself discloses that essentially the petitioners are alleging attempt to trespass against the private respondents. Inasmuch as, it is in relation to the land, petitioners are at liberty to approach the Civil Court and obtain the appropriate suitable injunctive orders against the private respondents.
Accordingly, the writ petition is disposed of. There shall be no order as to costs."
Since W.P.No.17964 of 2016 is filed for the self same relief, which was claimed in W.P.No.20280 of 2016, wherein liberty has been given to the petitioners to approach the Civil Court to seek injunctive relief, no orders need to be passed in this Contempt Case, as there is no element of contempt.
Accordingly, the Contempt Case is dismissed. No order as to costs.
