HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRL.R.C.No.646 of 2016 ORDER:

The present Criminal Revision Case came to be filed under Sections 397 and 401 of Cr.P.C. challenging the order dated 12.01.2016 passed in F.C.O.P.No.131 of 2013 on the file of the Family Court, S.P.S.R. Nellore, wherein the trial Court awarded maintenance at Rs.7,500/- per month to the first respondent herein. The facts in issue are as under :

The petitioner is the husband of the first respondent herein. First respondent herein filed O.P. under Section 125 Cr.P.C. claiming monthly maintenance at Rs.25,000/-. By an order, dated 12.01.2016 the trial Court awarded monthly maintenance at Rs.7,500/- to the first respondent. Challenging the same the petitioner-husband filed the present revision.

Pending the revision, the parties have compromised the matter, which lead to filing of joint memo vide S.R.No.2597 of 2016 seeking permission of the Court to record the compromise and allow the revision.

Today the petitioner and the first respondent are present and they are identified by their respective counsel namely Sri Challa Srinivasa Reddy and Sri Amancharla Satish Babu. Since both the parties are advocates, they were examined in Chambers. When examined, the first respondent stated that she has settled the matter with the petitioner and has no objection for allowing the case. She further submits that in view of the settlement arrived at, the petitioner agreed to pay Rs.9.00 lakhs. The affidavit which has been filed in support of the joint memo affirms the same.

A reading of the affidavit would show that at the intervention of elders and well wishers, both the parties have entered into a compromise. As per the terms of compromise, the petitioner paid a sum of Rs.9.00 lakhs by way of D.D.bearing No.06623 dated 18.04.2016 drawn on State Bank of Hyderabad, High Court Branch and D.D.No.773780 dated 18.04.2016 drawn on Syndicate Bank, Banjara Hills Branch, which were handed over to the first respondent. The same are acknowledged by her.

Having regard to the fact that there is a compromise between the parties and that the first respondent has received a sum of Rs.9.00 lakhs towards her full satisfaction, the request of the parties permitting them to compromise the matter can be accepted. Accordingly, the Criminal Revision Case which has been filed questioning the order dated 12.01.2016 passed in F.C.O.P.No.131 of 2013 on the file of the Family Court, S.P.S.R. Nellore is allowed. As a sequel thereto, Miscellaneous Petitions pending, if any, in this Crl.R.C. shall stand closed.
