HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35553 of 2016 ORDER:
This writ petition is filed seeking to declare the action of the 4th respondent in registering the FIR No.167 of 2016, as illegal and arbitrary.
Heard and perused the material available on record. The main grievance of the petitioner is that the petitioner gave money to the 5th respondent and the 5th respondent mortgaged his property in favour of the petitioner. When the petitioner approached the 5th respondent for repayment and he gave Agreement of Sale-cum-GPA in favour of the petitioner for selling his property and the petitioner paid the balance to the 5th respondent and that the II Town Police Station has opened a rowdy sheet against the petitioner and basing on the rowdy sheet, the 4th respondent is calling the petitioner to the police station on any incident which occurred in his village.
Learned counsel for the petitioner submitted that the 4th respondent is interfering with the recovery of money which is a case in civil nature and it is also informed that the petitioner has paid the balance amount to the 5th respondent. Considering the grievance of the petitioner, the 4th respondent is directed to complete the investigation in FIR No.167 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is directed to appear before the 4th respondent daily for a period of ten (10) days at 10.00 a.m.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO, J Date: 21st October, 2016 KL
