HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 15444 of 2009 ORDER:

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 1st respondent in passing the order No.9284/E2/2009-2 dated 15.07.2009 nominating the 4th respondent to represent the State Government as its nominee to the Dental Council of India for a term of five years, as illegal and arbitrary. On 30.07.2009, this Court issued rule nisi and called for records returnable in four weeks. Thereafter, by an order dated 07.07.2011, this Court dismissed W.P.M.P.No.20279 of 2009, which was filed by the petitioner seeking suspension of the order under challenge, holding as follows:

"A perusal of the proceeding sheet shows that no interim order has been passed so far. Since the impugned order has obviously come into effect enabling respondent No.4 to function as a nominee of the State Government, I do not find the elements of balance of convenience and irreparable injury in favour of the petitioner for granting the interim order at this length of time."

At the time when the matter is taken up for hearing today, the learned counsel for the petitioner submits that pursuant to the impugned order, the 4th respondent took charge, and by now, his tenure must have been completed.

In view of the submission made by the learned counsel for the petitioner, nothing survives for adjudication in the writ petition, and accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Consequently, miscellaneous petitions if any pending in the writ petition shall also stand dismissed.
