HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.2339 of 2006 ORDER:

This Writ Petition is filed seeking to issue writ order or direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the respondents in making attempts to allot the land admeasuring Ac.5.00 guntas situated in Sy.No.120/E of Kothapalem village, Renigunta Mandal, Chittoor District, by dispossessing the petitioner without considering his application dated 15th December,2005 for regularization of the possession on payment of market value as arbitrary, illegal and consequently direct the respondents to consider his application.

It is the case of the petitioner that he is in peaceful possession and enjoyment of the land to an extent of Ac.5.00 guntas in Sy.No.120/E of Kothapalem village, Renigunta Mandal, Chittoor District and he filed an application dated 15th December, 2005 before the respondents for regularization of his possession on payment of market value in respect of the subject land. Pending application before the respondents and apprehending dispossession, he approached this court by way of this writ petition. Originally, there was interim stay granted on 10th February, 2006 in W.P.M.P.No.2835 of 2006 and subsequently, the same was dismissed by allowing vacate stay application on 28th September, 2006.

Government in counter stated that the application dated 15th December,2005 made by the petitioner was considered and the same was rejected by order dated 15th April, 2006 and the same was communicated to the petitioner on 16th April, 2006. In view of the same, this Writ Petition is dismissed giving liberty to the petitioner to challenge the same, if he was so advised. _____________________________ JUSTICE T.
