The petitioner challenges proceedings CCLA's Ref.

No.BCW3/ 176/ 2013, dated 09-05-2013, in the instant writ petition. The 1st respondent through the proceedings impugned while admitting the appeal, declined to grant stay of proceedings of the 2nd respondent in D.Dis.No.E1/ 879/ 2011 dated 17-09-2011. It is submitted that the appeal is still pending before the 1st respondent. Without considering the prayer of the petitioner for grant of interim measures, this Court considers it appropriate to direct the 1st respondent to consider and dispose of CCLA's Ref.

No.BCW3/ 176/ 2013 within eight weeks from the date of receipt of a copy of this order. The petitioner is directed to file copy of this order along with a Memo and seek a date for hearing in the appeal. The writ petition is disposed of accordingly. No order as to costs.
