HON'BLE SRI JUSTICE S. RAVI KUMAR WRIT PETITION No.3970 of 2003 ORDER:

This writ petition is filed challenging Award dated 29.10.2001 in I.D.No.273 of 1998 on the file of Industrial Tribunal-cum-Labour Court, Ananthapur.

2. Petitioner herein is a conductor in the second respondent's Corporation and he was found guilty of charges having failed to issue ticket to a passenger who boarded bus at Alampur X Roads and that closed the tray numbers of all denominations up to Stage No.7 without completing the above ticket issues, thereby violated the rule issue and start, which constitutes misconduct. 3 . The Industrial Tribunal-cum-Labour Court found that the charge of misconduct was duly proved, but considering the fact that petitioner was in the act of issuing tickets, when the check took place, took a lenient view in respect of punishment and ordered for reinstatement without back wages giving continuity of service. Now aggrieved by the award for not granting back wages, present writ petition is filed.

4. It is represented that petitioner is already retired from service on attaining the age of superannuation. As seen from the material, the Labour Court in spite of holding that charge of misconduct is proved, sympathetically considered the case of petitioner and ordered for reinstatement. I do not find any grounds to hold that order of Industrial Tribunal is illegal or against the principles of natural justice.

5. Therefore, this Writ Petition is dismissed as devoid of merits. No costs.

Miscellaneous petitions, if any pending, in this writ petition shall

also stand closed.
