THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 46308 of 2016 ORDER:

This writ petition is filed for quashing F.I.R.No.801 of 2016 on the file of respondent No.2 In spite of the efforts made by the petitioner, notice taken out to respondent No.3 could not be served.

A reading of the complaint shows that the petitioner promised respondent No.3 to marry her, but later on he is avoiding. The complaint was filed in that connection.

Respondent No.2 filed a counter-affidavit stating that after registration of the complaint, the petitioner is absconding. In view of the nature of the allegation and the registration of the crime, this Court cannot interfere with the investigation process except directing respondent No.2 to follow due process of law while investigating the case.

The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall also stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:27.02.2017 kdl
