HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.16866 OF 2018 ORDER:

Heard Sri Kiran Tirumalasetti, learned counsel for the petitioners, learned Government Pleader for Home, appearing for respondent Nos.1 and 5, learned Government Pleader for Excise, appearing for respondent No.2, and learned Standing Counsel appearing for respondent Nos.3 and 4.

When the matter is taken up, written instructions, dated 12.06.2018 furnished by the Sub-Inspector of Police, Kukatpally Police Station, are placed on record by the learned Government Pleader for Home. The said instructions read as under:

"The petitioner herein has approached the Police of Kukatpally Police Station and lodged a complaint on 23.04.2018 stating that he is having G+1 building in Plot No.H.No.5-9286/1/NR and he is running Excel Industries firm at ground floor and on the 1st floor one Sudarshan Reddy is residing on rental basis and running pharma company and the said Sudarshan Reddy did not take any care about the chemical use and he complained the same to the Drugs Control Authority and keeping in view of same, the said Sudarshan Reddy called him to the 1st floor and threatened him with dire consequences and abused him in filthy language and beat him with hands and pushed him due to which he sustained minor injury to his ring finger and hence requested the police to take necessary action as per law. Basing on the contents of the above complaint, a case in Cr.No.351/2018 U/Secs.342, 506, 323 IPC dt.23.04.2018 was registered on the file of Kukatpally Police Station and taken up the investigation into the case.

The 7th respondent herein is shown as accused in the FIR. AVSS,J W.P. No.16866/2018 It is respectfully submitted that the investigation is at the initial stage. Necessary steps will be taken against the concerned accused in the FIR depending on the evidence adduced during the course of investigation into the case.

I assure to this Hon'ble Court that the investigation will be completed as expeditiously as possible.

It is pertinent to submit that action was taken on the complaint of the petitioner herein by way of registration of the above FIR No.351/2018 dt.23.4.2018 and taken up the investigation into the case."

Having regard to the contents of the above instructions, this Court deems it appropriate to dispose of the Writ Petition by placing the aforesaid instructions on record.

Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any pending, shall also stand disposed of in consequence.
