Challenge in this Revision Petition is the order rendered by the Court of X Additional Chief Judge, City Civil Courts, Hyderabad, in E.P.No.3 of 2003 in O.S.No.241 of 1999, dated 23.9.2015. Sri Sharath, Advocate, representing the learned counsel for the petitioner on record, submits that they are trying to locate the file and therefore, time may be accorded. On 06.4.2O22, there was no representation on petitioner's side. However, to give a fair opportunity, the matter was listed to 21.4.2022. On 2L.4.2022 d.so, there was no representation on petitioner's side. Learned counsel for respondent No.1 submitted on that day that his client received the entire decretal amount and therefore, the Revision Petition has become infructuous.
However, without dismissing the Revision Petition on that day, though there was no representation on petitioner,s side, yet the matter was posted to this day to give fair opportunity to the petitioner to pursue the matter. On this day, it is casually represented that they are trying to locate the bundle. The said ground is neither justifiable nor sufficient cause for granting adjournment.
Dr.CSL, J Having regard to the manner in which the matter is pursued and taking into consideration the representation made on this day, the Revision Petition is dismissed for non-prosecution without costs. As a sequel Miscellaneous applications pending, if any, shall stand closed.
