THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.46741 of 2016 ORDER:

This Writ Petition was filed challenging the action of the third respondent in not taking any action on the petitioner's complaint dated 16.12.2016.

Learned Government Pleader, on instructions, submits that on the basis of the complaint dated 16.12.2016, Crime No.12 of 2017 was registered on 28.01.2017.

In view of the above, no further orders are necessary in this Writ Petition, and the Writ Petition is, accordingly, closed. The miscellaneous petitions pending in this Writ Petition, if any, shall also stand closed. A counter affidavit is filed stating that, the petitioner has not lodged any complaint on 20.11.2016 with PS Nagayalanka, but has lodged a complaint with PS Nagayalanda on 08.01.2017 against respondent Nos.5 to 8 vide Crime No.5 of 2017 under Sections 467, 471, 420, 447 and 506 read with Section 34 IPC. During the course of investigation, the complainant and his wife were examined and their statements were recorded. After examining the petitioner's witnesses and collecting relevant documents from the concerned authorities, appropriate report will be filed before the concerned Court. The contents of the complaint dated 20.11.2016 are similar to the contents of the complaint dated 08.01.2017 and as FIR No.5 of 2017 has already been registered and investigation is in progress, the question of not taking any action in the matter does not arise.
