This writ petition is filed challenging the action of the respondents 4 and 5 in summoning the petitioner and her husband to attend the respondent No.4 Police Station.

Learned Assistant Government for Home produced written instructions dt.08.08.2019 produced by the Sub-Inspector of Police, Moinabad P.S., Cyberabad Commissionerate.

To the extent of their relevance to the present writ petition, the said instructions read as under:

" It is submitted that one Shabad Das Jagannadh gave a complaint to the Station House Officer, Moinabad on 06.08.2019 stating that one Munira Jagannadh, who is petitioner in the present writ petition erected some stone kaddies and fencing around the land in his absence, on 04.07.2017 when he noticed it and asked about it, he said that he will pay the land price shortly, further dodged the matter and finally threatened with dire consequences. It is submitted that on receipt of above complaint, GD entry was made and preliminary enquiry was done, during enquiry the Station House Officer called the petitioner to police station for enquiry, but the petitioner has not approached the Station House Officer. It is submitted that after completion of enquiry, a case was registered in Crime No.320/2019, under Sections 447, 427, 506 IPC of Moinabad Police Station on 06.08.2019, wherein the petitioner is arrayed as Accused No.1."

Learned counsel for the petitioner submits that the petitioner is not aware of registration of the crime.

In view of the aforesaid written instructions, recording the same, the writ petition is disposed of granting liberty to the petitioner to agitate his rights against registration of crime, in accordance with law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
